Training Services Terms and Conditions

Please read carefully before using our services.

Attention:

Please review this digital version of the Terms and Conditions, as the Trainer will request that you agree to and sign the PDF version of this document prior to commencement of the Program, Membership, or In-Home Services. Furthermore, by using Pet Lover's Passion Training Services, you agree to these Terms and Conditions regardless of whether you sign the document or not.

This Agreement between [Client Name] of [Full Address, or Zip Code, State, Country] who can be reached at [Email Address] and/or [Phone Number] (hereinafter referred to as “Client” or “Member”) and Heather Smith acting as agent for Pet Lover’s Passion (hereinafter referred to as “Trainer”) pertains to the following:

The Calm Dog, Happy Life Blueprint dog training program (hereinafter referred to as “Program”).

Dog Tricks Membership and/or Cat Training Membership (hereinafter referred to as “Membership”).

petloverspassion.com and/or petloverspassion.net (hereinafter referred to as “Website”).

This Agreement is binding upon all current and future dogs and/or cats in Client's household (hereinafter referred to as “Pet”).

This Agreement is binding upon all members of Client's household (hereinafter referred to as “Household”).

For good and valuable consideration, the parties agree as follows:

 

Program Fees

Client agrees to:

a.) Pay the one-time cost of Program in the full amount specified on the sales page at the time of purchase.

b.) Pay the cost of Program over the course of 4 months.

The price and value of Program may increase in the future, but the change will not affect Client unless they purchase again in the future.

 

Membership Fees

Member agrees to:

Pay the monthly fee in the amount specified on the sales page at the time of purchase.

Client understands and agrees that continued access to Membership is dependent on payment of monthly membership fee. Client may cancel their monthly membership at any time within the membership portal.

The price and value of Membership may increase in the future. Trainer will notify members of the price change via email and within membership as soon as the price change has been made.

 

In-Home Training Fees

If Client is within range (less than 30 miles from Trainer, as determined by Trainer), Client may purchase in-home training sessions at the rate of $40 per hour plus $1.00 per mile (one-way) that Trainer must travel.

Client agrees that in-home training fees paid to Trainer are nonrefundable and are due prior to commencement of the training session. Session prices may be calculated by the quarter-hour (15 minutes) independent of the mileage fee (example: 45 minutes is $30 plus the number of miles one-way).

 

Refund Policy and Guarantee of Results

Client/Member understands that, due to the digital nature of Program/Membership and the unpredictable nature of animals, there is a no-return policy. All sales final. No refunds will be issued, and specific behavior changes (results) are not guaranteed. See the “Program Results, Description of Services, and Disclaimers” section of these Terms for clarity and expectations.

 

In-Home Training Session Cancellations

Client may postpone a scheduled training session provided 24 hours’ notice is given to Trainer. Client understands and agrees that failure to give Trainer twenty-four hours’ notice of a session cancellation will result in Trainer counting said failure as a completed session.

In-Home Training Session No-Shows

If Trainer arrives at agreed upon training location at scheduled time and Client is not present, Client must pay 50% of the hourly rate for said scheduled session to make up for Trainer’s travel fees and time.

 

Program Results, Description of Services, and Disclaimers

Client understands that results of Program are completely dependent upon Client's commitment and utilization of the training suggested in Program.

Trainer agrees to provide Client access to Program, the goal being to teach Client how to train and work with Pet. Trainer will make every reasonable effort to help Client achieve training and behavior modification goals via video lessons, pdf downloads, and live group coaching calls, but makes no guarantee of Pet’s performance or behavior as a result of providing professional animal behavior consultation. Client understands that he/she and members of Client's household must follow Trainer’s instructions without modification, work with Pet daily as recommended, and consistently reinforce training being given to Pet.

Pet Massage is another topic that Trainer may cover in Program if Trainer deems it will help calm an anxious Pet or aid in Pet’s recovery of canine (or feline) sports. Trainer will not provide massage services to Pet if, in Trainer’s sole discretion, Pet is vicious or overly cautious of strangers, but rather, teach Client how to perform basic massage on Pet.

Trainer may also recommend dietary changes or herbal remedies specific to Pet if Trainer deems it will help with Pet’s behavior, health and wellbeing. Client understands that Trainer is not a veterinarian. It is Client’s sole responsibility to make an educated decision whether or not to utilize Trainer’s recommendations, and the results of any decision, whether desirable or harmful, are the sole liability of Client.

 

Transfer of Program or Membership

The purchase of Program includes access by Client/Member only. Access to Program and/or Membership is non-transferrable.

 

Review and Feedback of Program, Membership, and Services

Client agrees to give feedback and submit a testimonial of their experience in Program. Trainer may use Client comments as testimonials to promote Program in the future.

 

Digital Rights

Trainer and Pet Lover's Passion reserve all rights to all content posted within the program by Trainer or Pet Lover's Passion. Client understands that copying (via copy-pasting, screenshot, screen-recording, video, audio or by other means), storing (on their computer, USB drive, on the web, or by other means), or sharing (via print-out, social media, text message, email, video call, etc.) Program content (including photos, videos, text, audios, etc.) is in violation of Trainer's and Pet Lover's Passion's digital rights and copyright.

Client agrees not to share the contents of Program and/or Membership with anyone by any means. No part of Program and/or Membership material may be reproduced, distributed, or transmitted in any form or by any means, including but not limited to photo-copying, recording, or other electronic or mechanical methods, or by any information storage and retrieval system without the prior written consent of Pet Lover’s Passion. For permission requests, email [email protected] and include in the subject line “Permission Request”.

Client understands that downloadable content is intended for their success and the success of their household ONLY. Downloadable content may be stored by Client for Client's personal use, but may not be shared with anyone outside of Client's household. It is Client's responsibility to make sure Household has read, understand, and agreed to the Terms of this Agreement in its entirety prior to sharing downloadable content with Household. If any member of Household does not agree with any part of these Terms, they do not have permission to view Program and/or Membership content or related downloadable handouts.

Client understands and agrees that any recordings of live group coaching sessions may be recorded and used by Trainer ONLY, and may be uploaded into Program and/or Membership in the "replay" section. Trainer reserves all rights to live recordings, including the right to cut and/or edit live recordings at Trainer's discretion.

 

Software Requirements, Coaching Calls, and Additional Terms

Client agrees to Website Terms of Use (https://www.petloverspassion.com/website-terms-of-use) and Website Privacy Policy (https://www.petloverspassion.com/privacy-policy).

Client understands that Program includes live coaching calls throughout the month. However, in the circumstance that Trainer is no longer able to deliver these calls, either a.) someone else will take over, or b.) group coaching calls will discontinue. Client will still have access to all other Program and/or Membership content and recordings of past coaching calls, so long as Client continues Program membership and/or Membership.

Client understands that live coaching calls may be recorded by Trainer, and replays may be posted by Trainer inside Program.

Client understands that live coaching calls may be held on Zoom, Brave Talk (https://talk.brave.com/), or some other platform of Trainer's Choice. Client is subject to Zoom's Terms (https://explore.zoom.us/en/terms/) and Privacy Policy (https://explore.zoom.us/en/privacy/), and/or Brave Browser's Privacy Policy (https://brave.com/privacy/browser/#brave-talk-learn). Client will need access to a reliable internet service, and may need to have Zoom downloaded on their device in order to attend live group coaching calls; otherwise, calls can be viewed in Client's web browser.

Live coaching calls may not always be held on the same day each week/month. Client needs to remain active within Program/Membership and read when the next scheduled coaching call will be. Meeting links will be accessible inside Program and/or via email.

Client understands and agrees to the Terms (https://kajabi.com/policies/terms) and Privacy Policy (https://kajabi.com/policies/privacy) of Kajabi, the platform that Program and Website are hosted on.

Client understands that Program is only available in English.

 

Program Private Community and Private Membership Community(ies)

Client may have access to a private community only available to program members. This Community is intended to be viewed by Client only, and is for the benefit of Client and other Program members, with the intention of support and comradery. Respectful conduct is required at all times; see "Termination of Service".

Client is prohibited from advertising in the community, including but not limited to: affiliate links to products or services, direct or indirect sale of Client's products or services, or other such advertising. Disregard of this rule will result in termination of access to Program; see "Termination of Service". If Client wishes to promote a product or service, they may contact [email protected] with their proposal for collaboration.

 

Termination of Service

Client understands that inappropriate interaction between Client and other Program/Membership members or between Client and Trainer WILL result in termination from Program/Membership without recompense. Harassment of Trainer or other members will not be tolerated. Respect is due to everyone at all times.

Termination from Program/Membership may also result if Client breaches any term or condition of this Agreement.

Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

 

Miscellaneous

Client is responsible for purchasing all necessary equipment that Trainer recommends for training Pet.

Client assumes all risk and responsibility associated with taking (or allowing Trainer to take) Pet to a location to train (such as a park, etc.)

Client agrees that he/she will not use Trainer’s name on official documents (including but not limited to: service dog/support animal air carrier forms, etc.) without Trainer’s express consent.

 

Media Consent Release

a.) Client gives Trainer express permission to record sessions, in full or in part, for use in future products of digital nature, such as online video courses or instructional how-to videos (on but not limited to: Trainer’s website petloverspassion.com, YouTube, Facebook, Odysee, Rumble, CrwdView, or other platforms). Client understands that their voice, parts of their house, yard, or their person may appear, and Dog will appear in the video/audio recording and may end up on the internet. Trainer and/or Trainer’s agents will do their best to avoid getting Client’s face, street address, or other major identifiable information in video shots.

b.) Client gives Trainer and/or Trainer’s agents express permission to record interview-style videos (for the same uses described in the above paragraph), which include Client’s face.

Client may opt out of Media Consent Release (a.) and/or (b.) by emailing [email protected].

 

Liability

Media Consent: While Trainer will do everything in her power to protect Client’s identity and/or reputation, Client understands that Trainer has no control over what other people say or post on social media. Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.

Pet Massage and Pet Nutrition Education: Client understands that recommendations given by Trainer related to Pet’s care, nutrition, or health does not replace the advice of a qualified veterinarian. Trainer’s recommendations may differ from the advice of a veterinarian, and ultimately, any decision made is the sole responsibility of Client. Client assumes all risk with whatever decision he/she makes, and agrees that Trainer should not be held liable for any resulting injuries, losses, damages, costs or expenses.

In-Home Training, Day Training, and Board-and-Train: If Pet causes property damage, or bites or injures any animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Pet is injured in a fight, becomes ill, lost, stolen, missing or injured in any other manner during or after the term of this Agreement, whether Pet is under Trainer’s care or Client’s care, Client assumes the risk and agrees that Trainer and Trainer’s agents should not be held responsible for any resulting injuries, losses, damages, costs or expenses.

Client agrees to indemnify and hold harmless Pet Lover's Passion, Trainer, Affiliates, Community Moderators, and Trainer’s agents from any undesirable pet behaviors, events, injuries or property damage resulting from following the advice given in Program, Membership, and/or one-on-one sessions, whether in-home or online.

Client understands that other members are involved in Program and/or Membership, and views expressed by other members are solely that of other members, and not necessarily of Trainer, Pet Lover's Passion, Affiliates, Moderators, or Trainer’s agents. Client agrees not to hold Trainer, Pet Lover's Passion, Affiliates, Moderators, or Trainer’s agents liable for offensive language used by other members. Client should inform Trainer of complaints related to other members immediately by emailing [email protected] with the subject "Program Member Complaint" (or other similar language).

This Agreement is binding upon Client and all members of their household. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding Program/Membership, training and related matters, as described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Pet or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Pet will never bite, that Pet will not be dangerous or vicious in the future, that Pet will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. These Terms may be amended only by Trainer. Client will be notified within Program/Membership and via email of any changes to these Terms, should they affect Client.

If any part of this Agreement is deemed null and void, all other provisions of this Agreement shall remain in full force and effect.

By using Pet Lover’s Passion Training Services, Client/Member agrees to these Terms and Conditions (Agreement) whether a paper document is signed by both parties or not.

Executed on the date Client purchased Program, Membership and/or one-on-one training sessions (in-home or online) and payment information was processed.
